One may wonder why the Deer Creek Farms HOA only covers the phase 1 properties.
As the developer was building out Deer Creek Farms, he established covenants on the properties known as the ’93 covenants. But no legal HOA was created by the developer even though the development owned 6 acres of common property.
As a result of disputes between several of the phase 1 homeowners and the developer lawsuits emerged. The judge overseeing the lawsuits eventually ruled that all of the households in Phase 1 were litigants in the lawsuit, that the ’93 covenants were no longer valid for all phases of the development. And that the Phase 1 properties were responsible for the common property and required an HOA to be created.
In 2012 the Deer Creek Farm HOA was legally created encompassing the 43 properties in Phase 1. Shortly thereafter the 6 acres of common property were transferred to the water district serving the subdivision..

This map shows all three phases of Deer Creek Farm with boundaries between the phases. Only houses in Phase one make up the HOA. Only the lot numbers are shown for Phases 2 and 3.
